This Cancellation & Refund Policy explains the terms applicable to cancellation of orders, machinery procurement, project services, deposits, advance payments and refunds made through M/s MechRoutes Enterprises, operating under the brand name MechRoutes ("MechRoutes", "we", "us" or "our").

This Policy should be read together with the applicable quotation, purchase order, supply agreement, invoice, warranty terms, Shipping & Delivery Policy and MechRoutes Terms & Conditions.

Where the specific commercial agreement contains different cancellation or refund provisions, the specific written agreement shall prevail.

1. Nature of MechRoutes Orders

MechRoutes deals primarily in industrial machinery, equipment, components, spare parts, machinery packages, processing lines and project-based solutions.

Orders may involve:

  • Standard machinery;
  • Made-to-order machinery;
  • Customised machinery;
  • Machinery manufactured against customer specifications;
  • Machinery procured specifically for a customer;
  • Imported machinery;
  • Machinery packages;
  • Processing lines;
  • Installation and commissioning services;
  • Engineering or project coordination;
  • Spare parts and components; and
  • Other project-specific goods or services.

Because of the nature of these transactions, cancellation and refund rights may vary depending on the stage and nature of the order.

2. Order Cancellation

An order may be cancelled only in accordance with the applicable quotation, purchase order, agreement or this Policy.

Submitting a cancellation request does not automatically constitute cancellation of the order.

Cancellation shall become effective only after written confirmation from MechRoutes.

The request should include:

  • Customer name;
  • Company name, where applicable;
  • Order/quotation number;
  • Invoice number, if applicable;
  • Date of order;
  • Product or machinery details; and
  • Reason for cancellation.

3. Cancellation Before Procurement or Manufacturing

Where a customer requests cancellation before procurement, manufacturing or customisation has commenced, MechRoutes may consider the cancellation subject to:

  • Supplier terms;
  • Administrative costs;
  • Payment-processing charges;
  • Engineering or quotation costs already incurred;
  • Other non-refundable costs; and
  • The terms of the applicable quotation or agreement.

Where applicable, the refundable amount shall be determined after deducting amounts that MechRoutes is contractually or reasonably required to retain or pay to third parties.

4. Cancellation After Procurement Has Started

Once MechRoutes has placed a procurement order with a manufacturer, OEM, supplier or other third party specifically for the customer, cancellation may not be possible or may be subject to cancellation charges.

Any refund, if available, shall depend on:

  • Supplier/manufacturer cancellation terms;
  • Amounts already paid to suppliers;
  • Materials already purchased;
  • Engineering work already completed;
  • Customisation already performed;
  • Logistics arrangements;
  • Administrative expenses; and
  • Other costs incurred for the order.

5. Customised or Made-to-Order Machinery

Customised or made-to-order machinery is generally not eligible for cancellation or refund once manufacturing, engineering, procurement or customisation has commenced, except where required by applicable law or expressly agreed otherwise in writing.

This may include machinery:

  • Manufactured according to customer specifications;
  • Modified from a standard model;
  • Built for a particular production requirement;
  • Configured specifically for a customer;
  • Manufactured with customer-specific dimensions;
  • Manufactured with customer-specific automation;
  • Manufactured with special components; or
  • Otherwise unsuitable for resale to another customer.

6. Imported Machinery

Orders involving imported machinery may be subject to additional cancellation restrictions.

Once an import, manufacturing, shipping, freight, customs or other international procurement process has commenced, cancellation may result in costs that are non-refundable.

Any applicable refund shall be determined after considering:

  • Supplier cancellation terms;
  • Foreign exchange costs;
  • Banking charges;
  • Freight;
  • Insurance;
  • Customs-related costs;
  • Documentation;
  • Cancellation charges;
  • Storage;
  • Port charges; and
  • Other costs already incurred.

7. Advance Payments

Advance payments may be required before procurement, manufacturing, customisation or project execution begins.

An advance payment does not automatically guarantee that the entire amount will be refundable upon cancellation.

Where MechRoutes has incurred costs or become contractually committed to third parties, those amounts may be deducted from any applicable refund.

The exact treatment of advance payments shall be governed by the applicable quotation or agreement.

8. Project and Turnkey Orders

For projects involving multiple machines, processing lines, packaging lines, plant expansion, automation, installation, commissioning or turnkey solutions, cancellation may be assessed based on the stage of the overall project.

Costs may have already been incurred for:

  • Engineering;
  • Design;
  • Technical drawings;
  • Procurement;
  • Manufacturing;
  • Site visits;
  • Project management;
  • Installation planning;
  • Logistics;
  • Third-party services; or
  • Other project activities.

Such costs may be non-refundable where permitted by the applicable agreement.

9. Installation and Service Cancellation

Where installation, commissioning, inspection, training, technical support, maintenance or other services have been scheduled, cancellation may be subject to applicable service charges.

If personnel, technicians, contractors or service providers have already been booked or mobilised, costs incurred may be deducted from any applicable refund.

10. Cancellation After Dispatch

Once machinery or equipment has been dispatched, cancellation will generally not be permitted except where expressly agreed or required under applicable law.

The customer may be responsible for:

  • Return transportation;
  • Loading and unloading;
  • Insurance;
  • Storage;
  • Restocking;
  • Inspection;
  • Repackaging;
  • Customs charges;
  • Duties and taxes;
  • Supplier charges; and
  • Other applicable costs.

11. Delay-Based Cancellation

An estimated delivery date does not automatically create a right to cancel an order.

Where a delay occurs, MechRoutes may provide a revised estimated delivery schedule.

If a material delay continues beyond the contractual period specifically agreed in the applicable purchase or supply agreement, the customer's cancellation rights, if any, shall be determined according to that agreement.

12. Refunds

Where a refund is approved, the refund amount will normally be calculated after deducting applicable:

  • Cancellation charges;
  • Supplier/manufacturer charges;
  • Procurement costs;
  • Manufacturing costs;
  • Engineering costs;
  • Customisation costs;
  • Logistics costs;
  • Payment-processing charges;
  • Banking charges;
  • Taxes or government charges that cannot be recovered;
  • Storage charges;
  • Third-party service charges; and
  • Other costs properly attributable to the cancelled order.

Where no refund is contractually or legally due, amounts already paid may be retained to the extent permitted by the applicable agreement and law.

13. Refund Method

Approved refunds will generally be made through the original payment method or another method mutually agreed with the customer.

Where payment was made through a third-party payment provider, the refund may be subject to that provider's processing procedures and timelines.

14. Refund Timeline

Where a refund is approved, MechRoutes will normally initiate the refund after:

  1. Cancellation has been formally approved;
  2. Relevant supplier or third-party accounts have been reconciled;
  3. Any returned goods have been received and inspected, where applicable;
  4. Applicable deductions have been determined; and
  5. Required documentation has been completed.

The actual time for funds to appear in the customer's account may depend on the banking institution or payment service provider.

15. Non-Refundable Costs

Depending on the circumstances, the following may be non-refundable:

  • Custom engineering;
  • Design and technical work;
  • Special tooling;
  • Custom components;
  • Materials purchased specifically for the order;
  • Manufacturer cancellation charges;
  • Supplier deposits;
  • Import-related expenses;
  • Freight;
  • Insurance;
  • Customs charges;
  • Installation mobilisation;
  • Site visits;
  • Third-party professional services;
  • Payment-processing fees;
  • Banking charges; and
  • Other costs already incurred or contractually committed.

16. Customer-Caused Cancellation

Where cancellation occurs because of the customer's:

  • Failure to make payment;
  • Change in requirements;
  • Failure to provide required information;
  • Failure to approve drawings;
  • Failure to provide site readiness;
  • Failure to accept delivery;
  • Failure to obtain required licences or approvals; or
  • Other customer-related circumstances,

MechRoutes may recover applicable costs and losses to the extent permitted by the applicable agreement and law.

17. Return of Standard Products

Standard, non-customised products may be considered for return only where the applicable quotation or agreement expressly permits return.

Returned products may be subject to:

  • Prior written approval;
  • Inspection;
  • Restocking charges;
  • Return transportation costs;
  • Packaging requirements; and
  • Other applicable conditions.

Products that have been used, modified, installed or damaged may not qualify for return unless otherwise agreed or required by law.

18. Defective or Damaged Machinery

A product alleged to be defective shall be handled according to the applicable warranty and contractual terms.

Customers should first contact MechRoutes with:

  • Order details;
  • Product details;
  • Description of the issue;
  • Photographs or videos;
  • Relevant technical information; and
  • Other documentation reasonably required to investigate the claim.

Where appropriate, MechRoutes may coordinate inspection, repair, replacement or warranty support with the relevant manufacturer or supplier.

A product shall not automatically qualify for a refund merely because a technical issue has been reported.

19. Warranty Claims Are Not Automatic Refunds

Where a machinery problem is covered under warranty, the applicable remedy may include:

  • Repair;
  • Replacement of components;
  • Technical support;
  • Service visit;
  • Recommissioning; or
  • Another remedy specified under the applicable warranty.

Refunds shall be provided only where required under the applicable agreement, warranty terms or law.

20. Shortage or Damage on Delivery

Where a customer receives a shipment with visible damage or missing items, the customer should:

  1. Record the issue at delivery;
  2. Take photographs and/or videos;
  3. Note the issue on the delivery documentation where possible; and
  4. Notify MechRoutes promptly.

Claims will be assessed according to the applicable delivery terms, insurance arrangements, carrier conditions and commercial agreement.

21. Taxes and Government Charges

Where taxes, duties, customs charges or other government charges have already been paid and cannot be recovered, such amounts may not be refundable.

Any refund of taxes shall be subject to applicable tax laws and the ability of MechRoutes to legally recover or reverse the relevant tax.

22. Force Majeure

Cancellation and refund rights may be affected by events beyond MechRoutes' reasonable control, including:

  • Natural disasters;
  • Fire;
  • Flood;
  • War;
  • Civil disturbance;
  • Government restrictions;
  • Strikes;
  • Transportation disruption;
  • Port restrictions;
  • Customs restrictions;
  • Supplier failure;
  • Manufacturing disruption;
  • Severe weather;
  • Regulatory changes; or
  • Other force majeure events.

The consequences of such events shall be determined according to the applicable commercial agreement and law.

23. Fraudulent or Unauthorised Transactions

MechRoutes reserves the right to investigate and suspend transactions where fraud, unauthorised payment, identity misuse or other unlawful activity is suspected.

Refunds relating to fraudulent or disputed transactions may be subject to investigation and applicable payment-provider procedures.

24. No Automatic Refund

Submission of a cancellation request does not automatically entitle the customer to a refund.

Each cancellation request will be evaluated based on:

  • The nature of the product;
  • Order stage;
  • Contractual terms;
  • Supplier commitments;
  • Manufacturing status;
  • Customisation;
  • Dispatch status;
  • Payments already made;
  • Costs already incurred; and
  • Applicable law.

25. Commercial Agreements Prevail

This Policy is intended to provide general guidance.

For a particular transaction, the cancellation and refund provisions contained in the applicable:

  • Quotation;
  • Purchase order;
  • Supply agreement;
  • Service agreement;
  • Invoice;
  • Warranty terms; or
  • Other signed commercial document

shall prevail over this general Policy to the extent of any inconsistency.

MechRoutes may update this Cancellation & Refund Policy from time to time.

The updated version will be published on the MechRoutes website with the revised "Last Updated" date.

28. Acceptance

By placing an order, making a payment, accepting a quotation or entering into a transaction with MechRoutes, you acknowledge that you have read and understood this Cancellation & Refund Policy.
